SEC lawyers now need to get permission from politically appointed leaders before launching an investigation. This change reinforces expectations that the Trump administration is taking a more sector-friendly approach to financial markets.
In the past, the SEC had delegated its investigative authority to lower-level officials. However, now approval from upper management will be required for all official investigations, which could slow down the process. The new regulation aims to reduce the investigative pressure on companies and individuals, but critics believe it will weaken the SEC's ability to act independently.
The current leadership of the SEC consists of three members: Republicans Mark Uyeda and Hester Peirce and Democrat Caroline Crenshaw. While the confirmation of Paul Atkins, appointed by Trump as the chairman of the SEC, is expected, he is also expected to pursue a more relaxed policy in market regulations.
