The European Union will classify ChatGPT as a "super-large search engine" within a few days, bringing it under DSA regulation.

The DSA has regulatory requirements for very large platforms and very large search engines, with the latter needing to additionally comply with recommendation algorithm and advertising transparency obligations. The trigger threshold is over 45 million monthly active users in the EU, while ChatGPT’s active users in Europe have exceeded 120 million, far surpassing this standard. The timing is noteworthy: OpenAI has recently begun testing advertising features within ChatGPT, and the DSA’s advertising transparency provisions will require it to disclose the operational logic of its recommendation systems and ad placement mechanisms.
