Foresight News reports that, according to Cointelegraph, the lawyer for Tornado Cash developer Roman Storm submitted a motion to the court requesting reconsideration of the motion to dismiss, accusing the prosecutor of concealing communication evidence with FinCEN from 2023. The documents show that non-custodial encryption mixers do not fall under the legal definition of “money transmission business,” and the prosecutor has been aware of this guidance since 2023 but has continued to prosecute the Samourai Wallet and Tornado Cash developers.
